While we are now the verge of having a legalized recreational marijuana industry in California, many in Los Angles fear they won’t be able to join this growing and prosperous industry due to having a conviction involving marijuana on their record. As discussed in a recent article from Civilized, marijuana laws disproportionately affect those in minority communities, and some city lawmakers in Los Angeles are hoping to reverse these negative effects.

There has been a growing acceptance of medical marijuana use across the nation, and it has reached the point where at-least 29 states and other federal jurisdictions have legalized medical marijuana.  Some states have legalized marijuana for recreational use as well including California. In some states, the legalization of medical marijuana came from the state legislature, and in other states, it was done through direct voter initiatives and propositions put on the ballot. This can be done by getting enough signatures from voters, and the initiate will be placed up for a vote at the next election.

marijuana business lawyerOne of the major issues is that marijuana is still listed as a Schedule One Controlled Substance on the U.S. Controlled Substances Act of 1970 (USCSA).  A Schedule One controlled substance, under federal drug laws, is one that has a high potential for abuse, is dangerous to users and the general public, and there are no accepted medical uses.  This was done for political reasons and while there is no sense in saying that marijuana is more dangerous or potentially addictive than Oxycontin, congress has been unwilling to remove or reschedule marijuana, and it is unclear whether that will happen in the near or even distant future. With wildfires tearing across California, many homes are being destroyed, as are other businesses including medical marijuana farms, and unlike other businesses, these farmers cannot have insurance policies on their grow operations because federal law prohibits insurance carriers from writing such policies.marijuana attorney

According to a recent news article from the Cannabist, a company that runs a major online crowdsource, has just pulled the plug on a campaign hosted on their platform to raise money for  the farmers who lost a great deal to the massive wildfires in Northern California. The clear majority of the residents of Los Angeles, Orange County and other parts of California support the use of medical marijuana. As we learned during the last major election, most voters in our state also now support the sale of marijuana for recreational use too.  The next question that may be needed to be answered by voters is whether marijuana and other cannabis products are legal to give to pets such as cats and dogs for therapeutic use.

A university in Michigan is breaking new ground on higher education by offering an advanced degree in marijuana. marijuana attorney

The program at Northern Michigan University in Marquette involves medical plant chemistry, and it started just this semester. About a dozen students are enrolled in the class, which combines horticulture, botany, biology, chemistry, finance and marketing. The program is unique in that, while other schools do offer classes on marijuana law and marijuana policy, none other offers this kind of comprehensive coursework. First off, it’s not a single class but a full, four-year degree. Secondly, it addresses both the science and business aspect of marijuana cultivation and sales. Graduates will be uniquely situated to open their own marijuana business.

Although there are some joking about the ease of such a program, those who are enrolled in or teaching it say it’s not simple at all. The coursework is complex and varied.  Continue reading

When Colorado became one of the first states to legalize marijuana, there were voices of opposition railing it would be the gateway to harder drugs. Now, a new study reveals legal marijuana may actually be saving lives. marijuana business lawyer

Published in the American Journal of Public Health, the research examined the link between the legalization of recreational use cannabis in Colorado and the number of opioid-related deaths. What study authors discovered was one of the only places in the nation so far to have experienced a reversal in the upward trend of opioid deaths. Following the opening of the first shops selling recreational use marijuana in 2014, Colorado’s opioid deaths dropped by 6 percent over the course of two years.

Researchers were careful to say these findings are preliminary, and examine the just two years of data in a single state. However, those results are promising, and echo the voices of support have been saying from the beginning: Marijuana – which has far fewer risks compared to opiates – can be used as a substitute for those who might otherwise turn to more powerful (and dangerous) prescription drugs.  Continue reading

Throughout October 2017, devastating wildfires have taken lives and caused millions of dollars in damage all across California. While the destruction is tragic for all Californians who have been affected, one particular group of small business owners have been hit especially hard by damage. Marijuana growers are generally prohibited from insuring their businesses. This has left many Northern California marijuana growers with vast amounts of property damage and destruction, but no manner of recouping their losses. Why Marijuana Farmers Cannot Insure Their Businesses

Marijuana is entirely prohibited under federal law. There are no provisions for personal or even medicinal usage. Because of this, insurance carriers – most of whom are subject to federal regulations – are prohibited from insuring the businesses, products, or assets of marijuana businesses. Even when businesses are cultivating cannabis lawfully under the state’s Medical Marijuana Program (California Health and Safety Code §11362.7 to 11362.85), they are not able to access insurance coverage. These business losses have been even greater due to the timing of these wildfires. Salon reports that many business owners have spent “their life savings” getting permits and preparing their crops for legal sales on January 2, 2018. Continue reading

The recreational use of marijuana is now legal within the State of California. However, this does not mean that all dangers associated with marijuana have been eliminated. In an effort to ensure the safe use of recreational marijuana, the California Department of Public Health has launched a campaign to educate the public about the dangers of marijuana and its safe use. State Public Health Officer Dr. Karen Smith reports to the Los Angeles Times that the goal of this campaign – largely centered around the Department’s “Let’s Talk Cannabis” website – is to provide Californians with scientific evidence in order to ensure safe and informed decisions are made about marijuana use. For example: one major focus of the campaign is to highlight the fact that marijuana use is illegal for persons under twenty-one years of age. The campaign supplements this simple legal fact with the scientific reasons for its existence: namely, marijuana use in the late teens and early twenties can lead to physical changes in the brain, which are found less frequently in older users.
