Every year, we see additional states legalizing medical marijuana. In some states and the District of Columbia, we have actually had votes for full legalization of marijuana, even for recreational purposes. This definitely seems the way things are going. However, for the most part, the states along the eastern seaboard have been more reluctant to legalize medical marijuana than western states like California. Even in NY, which has recently allowed for the first dispensary to be opened, it is very difficult to get a medical marijuana license to purchase medical cannabis unless you have a terminal illness or severe neurological disease.

578107_vote_here_woman.jpgHowever, the residents of Florida to a large extent are trying to buck this trend and get medical marijuana legalization on the ballot for the upcoming election. According to a recent report from the Sun Times, advocates for legal medical marijuana have just obtained more than 500,000 signatures on the petition for the ballot initiative.

Under local law, in order for the initiative to legalize medical marijuana to get on the ballot for the upcoming election, the group needs to have at least 683,168 signatures no later than the first of February 2016. With the People United for Medical Marijuana organization having turned over approximately 523,000 signatures this week, there are still over a hundred thousand signatures left to get, but the group believes they are on track to get the medical marijuana initiative on the ballot.

There has been a huge increase in the support for medical marijuana legalization across the nation since California legalized medical marijuana 20 years ago. However, it has been in the past 10 years that we have seen such a large surge of support and more and more jurisdictions voting to legalize medical marijuana. Although, it should be noted that in most jurisdictions, politicians seem unwilling to pass legislation without a voter-driving mandate or proposition, because even though the majority of the public supports legalization of medical marijuana, politicians do not think it is politically expedient for them to make such a proposal.

However, unlike in Los Angeles, where medical marijuana is easy to get and readily accepted by society, the governor of New York is only doing just enough to comply with the law, according to a recent news feature from Clapway.

According to a recent news feature from the Orange County Register, cities throughout Orange County, California are “scrambling” to ban medical cannabis cultivation or distribution and delivery in their respective jurisdictions. For the most part, these were already places that did not permit medical marijuana dispensaries or grow operations, but now that the state has required an overt ban and a fast approaching deadline, these jurisdictions are going out of their way to fight against medical marijuana.

dutch-weed-2-jpg-1206038-m.jpgThe deadline set by the state for these cities in Orange County and across the state to ban medical marijuana in their communities is March 1, 2016. The proposed bans will include cultivation of medical marijuana, brick and mortar dispensaries, and mobile delivery services. Much like so-called dry counties that exist in some parts of the nation that do not allow for the sale of alcohol by the drink or in stores, it does not mean that it is illegal for private citizens to purchase the banned substance elsewhere and bring it home.

One of the hardest things to resolve when dealing with medical marijuana and even recreational marijuana legalization is how people are still being sent to prison on marijuana related charges in states where the drug is legal. Part of the problem is that possession of any amount of marijuana is illegal under the United States Controlled Substances Act of 1970 (USCSA).

This means that Congress considered marijuana to be highly dangerous, highly addictive, and a drug that has absolutely no valid medical use. Despite the fact that we now know that none of those attributes are true, marijuana has remained a Schedule One controlled dangerous substance for more than 40 decades. This is as a result of lobbying, issues with taxation, and utter nonsense like “Reefer Madness” which was an anti-marijuana propaganda film made in 1936. This movie shows how marijuana leads to murder.

Washington and Colorado have become the first two states in the nation to legalize marijuana for recreational purposes. There were many predictions about what would happen if pot was legalized, and some of those predictions included increases in crime and high school dropout rates. There were also predictions that the respective state governments would make a lot of money in tax revenue from the sale of legalized marijuana for recreational purposes.

piggybankonmoney.jpgAs it turned out, we did not see a rise in crime or an increase in the number of kids dropping out of school. However, the predictions about all of the money that would be made from legalized recreational marijuana were all proven correct. According to a recent news article from the Orange County Register, Colorado raked in over $76 million in taxes in 2014, and, in 2015, that number increased almost a hundred percent with a revenue of more than $130 million. Washington state earned over $40 million in the first year and half, and is currently on a pace to reach over $60 million in the current fiscal year.

In the United States, the right to file for bankruptcy was established in the Constitution. Specifically, Article I, Section 8, clause 4, known as the Bankruptcy Clause, authorizes Congress to create uniform laws on Bankruptcy that are applicable throughout the United States. This law, and the ability to file bankruptcy was very important to the framers of the Constitution because it was an alternative to the archaic practice of putting people in debtor’s prison.

money-problems.jpgWhile debtor’s prison still existed in the United States for some time after the ratification of the Constitution, by the 1830s, the states that had debtor’s prisons were drafting legislation to minimize their presence. One of the reasons this was important was because, when people are willing to take economic risk and start a business, both the economy and the strength of the nation grows, and these were very important goals during the industrial revolution. If you didn’t have to go jail if your new business failed, you were more likely to take risks, and that is what many people did.

According to a recent news report from NBC Los Angeles, authorities have just arrested a suspect for possession of 26 firearms and a small medical marijuana grow operation. The man also allegedly was in possession of large amounts of ammunition for all the guns also allegedly in his possession. The defendant was 33 years old at the time of his arrest.

shotgun-shells-1207089-m.jpgThe affidavit in support of the warrant states that officers had probable to cause to believe defendant had illegal narcotics on the premises. The warrant also asserted that defendant was a member of a criminal street gang and had multiple felony convictions on his record.
Authorities say, when they entered the property, they immediately saw three firearms that were in a location allegedly accessible to the young children who were in the residence. They found more than two dozen other firearms and the ammunition during their search and also discovered what they are describing as a small indoor grow operation and around one pound of marijuana, which was seized during the execution of the warrant.

According to a recent news article form the Los Angeles Times, medical marijuana grow operations are targeted by enforcement officials to cut down on water use. Growers have been told specifically that they must be following the same rules as required for any agricultural business, and, in some cases, that means shutting down for the season.

waterfalls-1431191-m.jpgOne new regulation issued by the Water Quality Control Board for the Central Valley Region of California came in the form of an Order that is requiring all medical marijuana growers obtain permits before diverting or storing any water. It is a typical process for those running illegal grow operations to divert the flow of streams and create artificial dams to store water to irrigate their marijuana crops, which generally require a considerably larger amount of water than many other crops.

Wildfires are nothing new in California, but with the drought being as bad as it is this year, there has been a recent rash of wildfires, and they have been causing more damage and destruction than normal. According to a recent news article from the Los Angeles Times, two state dispensary owners are trying to do what they can to help victims of the Valley wildfire that has been more extremely destructive and hard to control. Many are displaced from their homes and out of work. For those who are medical marijuana patients, this can mean having to go without their much-needed medicine. It is hard to imagine how difficult it must for sick patients to be forced to evacuate their homes as they were being destroyed in a wildfire and not knowing where they would go.

rollingajoint.jpgIn an effort to help these wildfire victims, owners of two large medical cannabis dispensaries have decided to give each victim up to $200 worth of medical marijuana next week free of charge. Between the companies, there will be five separate dispensaries giving away free cannabis oil, cannabis spray, and vaporizing cartridges. A spokesperson speaking on behalf of the two separate companies that have decided to work together on this charitable initiative say that anyone seeking free medical cannabis will need to have a valid prescription and legal residence with the counties affected by the large Valley wildfire. Authorities have estimated that nearly 120 square miles have been consumed by the large wildfire and, as result, around 2,000 homes were destroyed and at least four people are dead.

According to a recent article from the Los Angeles Times, a study was conducted involving sixth graders, and it addressed the risks of whether these children would likely drive under the influence of drugs or alcohol when they are older. The goal of the agency was to reduce the risks by challenging their positive beliefs about marijuana when they were still young.

old-schools-class-room-881694-m.jpgThe study determined that 12 year olds who had negative views about using marijuana were much less likely to later drive under the influence of the drug than 12-year-old children who had positive feelings about marijuana use and thought it could be a way to help them relax and enjoy themselves. Study makers also concluded that these children who had positive feelings about using marijuana were also more likely to ride in a car with someone who was high or drunk. This study was published in professional journal for pediatricians.
